Terms of Service

These Terms of Service ("Terms") govern your use of the BE THE ONE mobile application and website at bethe.one ("Service"), operated by BE THE ONE ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms.

1. Description of Service

BE THE ONE is a personal development platform that provides daily rituals (exercise, breathwork, reading, affirmations), AI-powered coaching, gamification (XP, levels, streaks, leagues), and community features. The Service is designed for disciplined, purpose-driven growth.

2. Account Registration

To use certain features, you must create an account using Apple Sign-In or Google Sign-In. You are responsible for maintaining the security of your account and for all activity that occurs under it. You must provide accurate information and promptly update it if it changes.

Account and community service email is enabled when you register. These messages may include generic accountability alerts when a friend uses an in-app poke and other service updates tied to your account. This does not enroll you in product-education or marketing email. You can turn service email off at any time in app Settings or through the unsubscribe link in each message; turning it off does not affect account access.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Post content that is abusive, threatening, harassing, defamatory, obscene, or otherwise objectionable
  • Impersonate another person or misrepresent your identity
  • Spam, send unsolicited messages, or post repetitive content in community features
  • Attempt to access other users' accounts or personal data
  • Interfere with or disrupt the Service, servers, or networks
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Use automated tools (bots, scrapers) to access the Service
  • Manipulate gamification features (XP, streaks, leaderboards) through exploits or cheating

4. User-Generated Content

You may create content through community features (daily summaries, comments, likes). You retain ownership of your content but grant us a non-exclusive, worldwide license to display it within the Service. We may remove content that violates these Terms or is reported by other users.

You are solely responsible for the content you post. We do not endorse or verify user-generated content.

5. AI-Generated Content

The Higher Self coaching feature uses artificial intelligence (Anthropic's Claude) to generate responses. AI-generated content is provided for informational and motivational purposes only. It is not a substitute for professional medical, psychological, financial, or legal advice. You should not rely on AI responses for critical decisions affecting your health, finances, or legal matters.

We do not guarantee the accuracy, completeness, or suitability of AI-generated content.

6. Health and Fitness Disclaimer

The rituals and exercises provided in the app (pushups, breathwork, etc.) are general fitness activities. Consult a healthcare professional before starting any exercise program, especially if you have pre-existing conditions. We are not responsible for injuries resulting from use of the Service.

7. Intellectual Property

The Service, including its design, code, content, logos, and branding, is owned by BE THE ONE and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written permission.

8. Account Termination

You can request permanent deletion in app Settings or web Settings. Deletion begins after confirmation and is not reversible. You do not need to finish onboarding to request deletion. We may suspend access for a breach of these Terms.

Signing out or uninstalling the app is a break, not deactivation or deletion. Eligible unpaid accounts may be deleted after 12 calendar months of observed inactivity and three delivered warnings providing at least 30, 14 and 7 days' notice. Returning before deletion begins cancels the sequence. Paid access, uncertain billing or activity, missing delivery confirmation, and support holds prevent automatic deletion. Deleting an account does not cancel an Apple or other provider subscription. Cancel with your billing provider to stop future charges. You may delete your account while a subscription is active; this does not create a refund.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

10. Limitation of Liability

To the maximum extent permitted by law, BE THE ONE shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or personal injury.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

11. Indemnification

You agree to indemnify and hold harmless BE THE ONE, its officers, employees, and affiliates from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Modifications

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved in the courts of competent jurisdiction.
